A high-value dispute requires planning its cost and financial risk from the outset. We advise companies, funds and individuals on accessing external funding and on covering the risk of an adverse costs order, so that it is the strength of the claim — not its cost — that drives the strategy.

Third-party funding
We assess the case and negotiate on the client’s behalf with funds that specialise in financing high-value litigation and arbitration. It is available for court and arbitration proceedings and requires the matter to have strong prospects of success (around 70% or higher) and significant economic value.

Adverse-costs cover (After the Event insurance)
We arrange After the Event (ATE) insurance covering the risk of an adverse costs order and the costs of the proceedings in the event of an unfavourable outcome. This cover makes it possible to litigate while limiting the client’s financial exposure.
